BURNED ALIVE
Was J. F. Toadvine, and Elbert Dunn's store Destroyed.
Death by fire was the awful fate of J. F. Toadvine, an aged citizen of Avena, and the store building and stock of merchandize belonging to Mr. Elbert Dunn and destroyed by flames Friday night.
Mr. Toadvine, with his wife and daughter, lived in part of the building occupied by Elbert Dunn's store, Mr. Dunn having married Mr. Toadvine's daughter.
Some years ago he was afflicted with sun-stroke, and has been an invalid since. On last Friday night, Mrs. Toadvine and daughter left after supper to call on some neighbors. During their absence it is supposed that the lamp. which had been turned down, exploded and caused the conflagration from which the unfortunate man was unable to escape. When the fire was discovered it was beyond control and the building was consumed with Mr. Toadvine in his room. After the flames had spent their force the charred remains were recovered.
Mr. Dunn's loss was about $1,000 on the building and $1,000 on the stock of goods. He carried no insurance. It was with difficulty that his residence and barn were saved.
Mr. Dunn and Mrs. Toadvine ask the Log Cabin to express their gratitude to all those who helped fight the fire or in various other ways have rendered their kind assistance.

John Fletcher Toadvine was born 16 Feb 1823. Joined the Mt. Pleasant M.E. Church when quite a young man. Married Mary A. Roberts in 1849. They had 10 children, seven of whom still survive, two sons and five daughters also the wife and mother.

The death certificate of William and Margaret's son Matthew Kearns in 1921 says that Margaret's maiden name was Cunningham. However, according to THE FOOKS FAMILY IN AMERICA by Herbert C. Fooks, 1952, Peggy (standard nickname for Margaret), wife of Billie (standard nickname for William) Kearns, was a daughter of Benjamin Fooks. So there is doubt as to what Margaret's maiden name was.

Eliza Jane (Fooks) Kearns' tombstone in Lower Curry Cemetery, Harrison County, KY, says she was born 20 June 1820, but census records are more consistent with an 1822 year of birth. In the 1830 Census, Benjamin Fooks had one girl age 0-5 (probably Eliza Jane), one girl age 5-10 (probably Leah), and one girl age 10-15 (probably Christiana). In the 1840 Census, Benjamin Fooks had two girls age 15-20 (probably Eliza Jane and Leah) and one girl age 20-30 (probably Christiana).
Prior to his marriage to Eliza Jane Fooks in 1854, Thomas Kearns was married to Elizabeth Fooks (born ca 1817, died 1852). It is not known who the parents of Elizabeth Fooks were.

"WILLIAM THOMAS KEARNS - Among the skillful and successful agriculturalists of Harrison county is William T. Kearns, whose from on Two Lick pike constitutes one of the model rural estates of the community, being well improved and under a high state of culture. A son of Thomas B. Kearns, he was born April 10, 1842, on Curry's Run, Harrison county, coming from pioneer ancestry.
John Kearns, his paternal grandfather, a native of Virginia, followed the tide of emigration to Kentucky about 1795, and located on Two Lick pike, in Harrison county, where he purchased a tract of timber land, from which he hewed a homestead. In common with the other pioneers of that day, he labored with unceasing toil to provide a home for his family, helping in the meantime to develop the resources of this now rich agricultural region.
Thomas B. Kearns was born on the parental homestead, on Two Lick pike, Harrison county, in 1802, and here grew to manhood. When ready to establish a home of his own, he moved to Curry's Run, and having purchased a tract of heavily timbered land for the small sum of one dollar and twenty-five cents an acre he cleared and improved a farm, on which he lived and labored until his death, in 1886. He married first Jane Gardner, a native of Virginia, and of the three children born of that union two are now living, Richard Kearns and Daniel Kearns, both residents of Harrison county. He married for his second wife Elizabeth Fooks, who was born in Bourbon county, Kentucky. She died in 1852, at the early age of thirty years, and of their six children two now survive, namely: William Thomas, the subject of this brief sketch; and Lewis, of Harrison county. By his third wife, whose maiden name was Eliza Fooks, three children were born, as follows: Benjamin F., of Harrison county; James M., of the same county; and Arabella, wife of Jackson Lennous, of Harrison county. He was affiliated with the Democratic party in politics, and was a member of the Methodist Episcopal church, to which his wives also belonged."

"B. F. KEARNS. Rural school superintendent for Harrison County, B. F. Kearns is a veteran educator, and has given upwards of half a century to this dignified and important service to humanity.
He was born in Harrison County, October 16, 1855, a son of Thomas B. and Eliza (Fooks) Kearns. His paternal grandparents, John and Kate Kearns, were natives of Ireland, while his maternal grandfather was Benjamin Fooks, a native of England, whose wife came from the same country. These families established homes in Harrison County, Kentucky, more than a century ago, when all the country was new and civilization was just beginning in Kentucky. Thomas B. Kearns was born in Harrison County in 1808, and his wife was born in the same county in 1816. After their marriage they moved to a farm six miles north of Cynthiana, and their part in the community was that of industrious farmers and people who gave every influence within their power to good schools, churches and moral improvement. Thomas Kearns was superintendent of the County Infirmary during the Civil war period, from 1861 to 1865. He was an active democrat in politics, and his wife was a member of the Methodist Church. Of their twelve children five are still living: J. M. Kearns, a farmer and teacher; W. T. Kearns, who was a Confederate soldier and a farmer in Harrison County; L. N. Kearns, a farmer; Arabelle, wife of A. J. Lemons: and B. F. Kearns."
